This Intellectual Property Policy ("Policy") outlines PixoraHub.com's ("PixoraHub" or "Platform") commitment to respecting and protecting intellectual property rights. It describes the responsibilities of our users and Contributors, and the procedures for reporting and addressing intellectual property infringement. By accessing or using PixoraHub, you ("User," "You," or "Your") agree to comply with this Policy, the PixoraHub Terms of Service, and our other legal documents. Operating from Mozambique, PixoraHub serves a global community and adheres to international best practices for intellectual property protection.

 

1. Introduction

 

At PixoraHub, we are dedicated to fostering a creative and respectful environment where intellectual property is valued and protected. This policy serves to inform all users about our stance on intellectual property rights, the rights and responsibilities of content owners and users, and the procedures for addressing potential infringements on our platform.

 

2. PixoraHub's Commitment to Intellectual Property

 

PixoraHub respects the intellectual property rights of others and expects its users and Contributors to do the same. We are committed to promptly addressing claims of copyright and trademark infringement in accordance with applicable laws, including international treaties and local legislation in Mozambique.

 

3. Content Ownership on PixoraHub

 

3.1. Contributor's Intellectual Property

 

Contributors who upload Content to PixoraHub retain full copyright and other intellectual property rights in their submitted Content. By submitting Content, Contributors grant PixoraHub a license to sub-license the Content to users, as detailed in our Contributor Agreement Policy and Licensing Agreement Policy.

 

3.2. PixoraHub's Intellectual Property

 

All intellectual property rights in the PixoraHub Platform itself, including its design, text, graphics, logos, software, and underlying technology, are owned by PixoraHub.com or its licensors. You may not use any of PixoraHub's trademarks, logos, or trade dress without prior written permission.

 

4. User and Contributor Responsibilities

 

4.1. Respect for Third-Party Rights

 

All users and Contributors are strictly prohibited from uploading, posting, or otherwise transmitting any Content that infringes upon the intellectual property rights (including copyrights, trademarks, design rights, and patent rights) or other proprietary rights of any third party.

 

4.2. Model and Property Releases

 

Contributors are solely responsible for obtaining all necessary model releases for identifiable individuals and property releases for private property depicted in their Content. The absence of valid releases may constitute a violation of privacy rights or property rights.

 

4.3. Accurate Information

 

Contributors must provide accurate and truthful information regarding their ownership and rights to the Content they submit. Misrepresentation of ownership or rights is a serious violation of this Policy and our Contributor Agreement.

 

5. Reporting Intellectual Property Infringement (Takedown Policy)

 

PixoraHub operates a robust procedure for addressing claims of intellectual property infringement. If you believe that any Content on PixoraHub infringes your copyright, trademark, or other intellectual property rights, please follow the steps below to submit a formal notice of infringement.

 

5.1. Requirements for Infringement Notification

 

To submit an effective infringement notice, you must provide the following information in writing (preferably via email to legal@pixorahub.com or support@pixorahub.com):

 

  1. Identification of the Copyrighted Work or Intellectual Property: A clear and sufficient description of the copyrighted work or intellectual property that you claim has been infringed.

  3. Identification of the Infringing Material: A clear and sufficient description of the Content on PixoraHub that you claim is infringing, including its URL(s) or other specific identifying information on the PixoraHub platform.

  5. Your Contact Information: Your full legal name, mailing address, telephone number, and email address.

  7. Statement of Good Faith Belief: A statement that you have a good faith belief that the use of the copyrighted work or intellectual property in the manner complained of is not authorized by the copyright owner, its agent, or the law.

  9. Statement of Accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the owner, or authorized to act on behalf of the owner, of an exclusive right that is allegedly infringed.

5.2. PixoraHub's Response to Infringement Notices

 

Upon receipt of a valid and complete infringement notice, PixoraHub will:

  • Promptly review the complaint.
  • Remove or disable access to the allegedly infringing Content.
  • Notify the Contributor whose Content has been removed or disabled.
  • Take appropriate action against repeat infringers, which may include termination of their PixoraHub account.

5.3. Counter-Notification Procedure

 

If your Content has been removed or disabled due to an infringement notice, and you believe the Content was removed due to a mistake or misidentification, you may submit a counter-notification. Your counter-notification must include:

 

  1. Identification of the Content that has been removed or to which access has been disabled, and the location at which the Content appeared before it was removed or disabled.
  2. A statement, under penalty of perjury, that you have a good faith belief that the Content was removed or disabled as a result of mistake or misidentification of the Content.
  3. Your name, address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the courts located in Maputo, Mozambique, and that you will accept service of process from the person who provided the original infringement notification.
  5. Your electronic or physical signature.

Upon receipt of a valid counter-notification, PixoraHub will provide a copy to the original complaining party. Unless the complaining party files a court action seeking an injunction against the Contributor within a specified timeframe (e.g., 10-14 business days), PixoraHub may, at its discretion, restore the removed Content.

 

6. Consequences of Infringement

 

PixoraHub takes intellectual property infringement very seriously. Any Contributor found to be infringing the intellectual property rights of others will face consequences, which may include:

  • Immediate removal of the infringing Content.
  • Suspension or permanent termination of their PixoraHub account.
  • Forfeiture of any outstanding earnings.
  • Legal action by the intellectual property owner.

7. Disclaimer Regarding AI-Generated Content

 

While PixoraHub aims to accommodate emerging technologies, the intellectual property status of AI-generated content is complex and evolving. Contributors submitting AI-generated content must adhere to all representations and warranties regarding originality, ownership, and non-infringement. PixoraHub reserves the right to establish specific guidelines or restrictions for AI-generated content as legal and industry standards develop.

 

8. Amendments to Policy

 

PixoraHub reserves the right to modify this Intellectual Property Policy at any time. We will notify you of any material changes by posting the updated Policy on our Platform or by email. Your continued use of PixoraHub after such modifications constitutes your acceptance of the revised Policy.
