This Editorial Policy ("Policy") outlines the specific requirements, permissible uses, and restrictions for digital content designated as "Editorial Use Only" on PixoraHub.com ("PixoraHub" or "Platform"). This Policy is crucial for ensuring the responsible and legally compliant licensing of Content intended for news, public interest, and non-commercial purposes. It complements and should be read in conjunction with our Terms of Service, Contributor Agreement Policy, Licensing Agreement Policy, and Content Submission Guidelines. PixoraHub, operating from Mozambique and serving a global audience, is committed to upholding journalistic integrity and legal compliance in the distribution of editorial assets.
1. Introduction
PixoraHub provides a vast library of high-quality digital assets, including content intended specifically for editorial use. This policy distinguishes editorial content from commercial content and sets forth the strict conditions under which editorial assets can be submitted, licensed, and utilized. Our aim is to facilitate the dissemination of authentic and newsworthy visuals while meticulously respecting legal and ethical boundaries, particularly concerning privacy and publicity rights.
2. Defining Editorial Use
"Editorial Use Only" Content refers to digital assets that depict newsworthy events, public interest subjects, or current affairs, and which are intended solely for use in connection with informational, educational, or journalistic contexts.
Key Characteristics of Editorial Use:
- Informational/Newsworthy: Content relates to real-world events, public figures, current affairs, or subjects of genuine public interest.
- Non-Commercial: The primary purpose of using the Content is to inform, educate, or comment, rather than to promote, advertise, endorse, or sell a product or service.
- Authenticity: Editorial content should accurately represent the reality of the scene or event depicted, with minimal alteration.
-
3. When is Content Designated as "Editorial Use Only"?
Content is typically designated "Editorial Use Only" when:
- No Model/Property Releases: It features identifiable individuals or private property for which no valid model or property releases have been obtained. This is common for candid shots in public spaces, street photography, or depictions of events where obtaining releases is impractical or impossible.
-
- Public Figures/Events: It depicts public figures, historical events, current news, sports, or cultural events.
-
- Trademark/Logo Presence: It includes prominent trademarks, logos, or copyrighted designs that are an integral part of a newsworthy or public interest scene, and permission for commercial use has not been obtained.
-
It is the Contributor's responsibility to correctly identify and tag Content as "Editorial Use Only" during submission if it meets these criteria. PixoraHub also reserves the right to re-categorize Content as "Editorial Use Only" during the review process if releases are missing or if it contains restricted elements unsuitable for commercial licensing.
4. Permitted Uses of Editorial Content
Editorial Content licensed from PixoraHub may ONLY be used in the following contexts:
- News Reporting: In newspapers, magazines, news websites, television news broadcasts, and online news articles.
-
- Documentaries: In documentary films or television programs.
-
- Educational Materials: In textbooks, academic presentations, educational websites, or other materials solely for teaching purposes.
-
- Public Interest Publications: In non-commercial blogs, social media posts, or websites that discuss topics of public interest, provided no commercial gain is directly associated with the specific use of the image.
-
- Non-Promotional Contexts: For illustrative purposes in reports, articles, or other contexts that are purely informational or descriptive, and not intended to promote or endorse.
-
5. Prohibited Uses of Editorial Content
Editorial Content MAY NOT be used for any commercial, promotional, or advertising purposes whatsoever. This includes, but is not limited to:
- Advertising & Marketing: In advertisements, brochures, flyers, promotional materials, or any other marketing campaigns (print, digital, or broadcast).
-
- Product Endorsement: To endorse or promote any product, service, company, or cause.
-
- Merchandise/Print-on-Demand: On any product for resale, such as t-shirts, mugs, posters, calendars, phone cases, or any other merchandise.
-
- Commercial Websites/Social Media: On websites or social media pages where the primary purpose is to sell goods or services, unless the Content is used strictly within an editorial context (e.g., a news section of an e-commerce site).
-
- Trademarks/Logos: As part of a logo, trademark, or service mark.
-
- Sensitive/Defamatory Use: In a manner that is defamatory, libelous, obscene, or illegal. This also includes using Content in a way that suggests a person is suffering from a disease, engaging in immoral behavior, or committing a crime, unless the Content is genuinely newsworthy and depicts a verifiable public event, and such use is not derogatory.
-
- Altering Context: Modifying the Content in a way that fundamentally alters its meaning, intent, or the context of the event/person depicted.
-
6. Contributor Responsibilities for Editorial Submissions
6.1. Accuracy and Authenticity
- Truthful Representation: All editorial content must accurately reflect the reality of the scene, event, or individual depicted.
-
- Minimal Alteration: Only minor adjustments (e.g., cropping, exposure, white balance, dust removal) that do not alter the integrity or context of the image are permitted. Heavy retouching, selective colorization (unless part of a genuine artistic style), or removal/addition of significant elements is strictly prohibited.
-
- Metadata: Provide precise and detailed captions (who, what, where, when, why), keywords, and a clear "Editorial Use Only" designation during submission. Inaccurate metadata may lead to rejection or removal.
-
6.2. Copyright and Source
- You must be the copyright owner or have the necessary rights to submit the editorial content. PixoraHub does not permit the submission of content for which you do not hold the necessary rights.
- While model/property releases are generally not required for editorial use, you must still ensure that your Content does not infringe upon any third-party intellectual property (e.g., trademarks that are not incidentally captured in a newsworthy scene) or other rights.
-
7. PixoraHub's Review and Enforcement
